Terms and Conditions for Facebook Competition 08/04/2021

 

1. Information on how to enter, the collection of personal information and prizes forms part of these conditions of entry. Entry into the competition constitutes acceptance of these terms and conditions.

2. The competition is promoted by United Super Pty Ltd ABN 46 006 261 623 as trustee for the Construction and Building Unions Superannuation Fund (Cbus) ABN 75 493 363 262, 130 Lonsdale Street, Melbourne VIC 3000, Phone: 1300 361 784 (Promoter).

3. Entry is open to Cbus Members that are Australian residents over the age of 16. Employees of the Promoter (and their immediate families) and its subsidiaries and related entities are not eligible to enter.

4. The competition commences on Thursday 8/04/2021 at 09:00 AM AEST and closes on Sunday 18/04/2021 at 23:59 PM AEST (Promotional Period).

5. To enter the competition, entrants must, within the Promotional Period, view the Promoter’s Facebook post (https://www.facebook.com/cbussuperfund/photos/a.720654398001758/3863648043702362/) detailing the competition, and:

(a) Post your best photo of your creative masterpiece

The competition is a game of skill only and chance plays no part in determining the winner. Entry into the competition is free and entrants can enter multiple times. Entries will be judged on the creativity shown in how the entrants share their experience in a positive light within the community.

6. There will be three (3) prize winners. The winners will be selected on Monday  19/04/2021 at 10.0am AEST remotely from Melbourne and the winners will be notified on the same day via a comment or reply from the Promoter on the entrant’s Facebook comment.

7. The three prize winners will be selected from all entries received via the Promoter’s competition Facebook post at https://www.facebook.com/cbussuperfund/photos/a.720654398001758/3863648043702362/ with the winning entries being those entries which are deemed to be the most creative by Cbus. The three prize winners must be current Cbus members.

8. The three prize winners will receive a $50 Bunnings voucher.

The value of the prize is $50 each. Prize values are in Australian dollars and are the recommended retail value and are correct as at the date of these conditions of entry. The Promoter does not accept responsibility for any variation in the value of the Prizes.

9. The judges’ decision is final and no correspondence will be entered into. The prize is not exchangeable, transferable and non-cash prizes are not redeemable for cash.

10. The Promoter reserves the right to rejudge the competition in the event of:

(a) an entrant being unable to satisfy the competition conditions; or

(b) forfeiting; or

(c) not claiming a prize.

For any prize that remains unclaimed by Thursday 22/04/ 2021 at 10:00 AM AEST or forfeited through ineligibility or otherwise, the Promoter will award the prize to the next entry deemed to be the most creative. Winners will be chosen, based on the most creative entry, on Monday 19/04/2021 at 10:00 AM AEDT remotely in Melbourne. The winners will be notified via a comment or reply from the Promoter on Facebook on the same day.

11. All entries, prize images and any copyright subsisting in the entries and prize images become and remain the property of the Promoter who may publish or cause to be published any of the entries received.

12. Each entrant represents and warrants to the Promoter that neither the entry (nor its submission) nor the photographs provided or arranged by the entrants will breach any law or regulation or the rights of any third party (including any privacy or intellectual property law).

13. Incomplete, indecipherable or ineligible entries will be deemed invalid. The Promoter reserves the right to verify the validity of entries and entrants (including the entrant’s current Cbus member details, identity and address) and to disqualify any entrant who submits an entry that is not in accordance with or breaches these conditions of entry, who tampers with the entry process or who submits an entry that the Promoter, in its sole discretion deems to be offensive, inappropriate, defamatory or otherwise not in keeping with the spirit of the competition. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter reserves its legal rights to recover damages and/or other compensation from a person whom is in breach of these conditions of entry or whom engages in any unlawful or improper conduct calculated to jeopardise the fair and proper conduct of the competition.

14. If the competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law, and subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the competition as appropriate.

15. The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including, but not limited to, indirect or consequential loss and including equipment/communications line/telephone/mobile or satellite network failure, theft or destruction or unauthorised access (including by electronic means) to or alteration of entries) or for any personal injury suffered or sustained in connection with any entry or the Prize/s except for any liability which cannot be excluded by law.

16. The Promoter collects personal information so that it is able to conduct the competition. The Promoter may disclose personal information to third parties for the purpose of providing the Prizes. All entries become the property of the Promoter and may be used for communication and promotional purposes without further reference, payment or compensation to the entrant. The prize winners consent to having their name, entry and photographs they submit as part of this competition to be used by the Promoter for the purposes of this competition (including being posted to Promoter social media pages) and for other future promotional, marketing and publicity purposes.

17. Entrants consent to the Promoter’s use and disclosure of information about them as contemplated by Clause 16 and agree to their personal information being used for this purpose. If entrants do not consent to their personal information being used in accordance with Clause 17, they should contact the Promoter using the details set out in Clause 2.

18. The Promoter’s privacy policy is available at www.cbussuper.com.au and it includes details about how individuals can seek access to and correction to their personal information and how they can make a privacy complaint.

19. Each entrant releases Facebook from all liability whatsoever related to the competition.

20. Entrants acknowledge that the competition is in no way sponsored, endorsed or administered by, or associated with Facebook.
